Is there a Lawyer in the House?
hey group,
this is a transient personal matter. i am sad to report that after all this
time, i am still being harassed by sprint's creditors over a year after this
incredible problem first started in november 2004. it is a long story that i
have written about and documented every nuance of. i fought them with the
kentucky public service commission and we proved blatant fraud had taken
place; they apologized and when i paid the actual fair cost of the long
distance (they wanted about 450 dollars for less than two weeks of normal
telephone usage) i was told that it was over. for the last three weeks the
calls have been coming again, and just like before, they are getting more
and more frequent as time goes on.
i have the digital audio files and paperwork on a cd that proves that
blatant fraud has taken place. we won half of it, but now the other half is
throwing me against a bureaucratic brick wall. kentucky can't fight for me
because the other part of the equation occurred in virginia.
i have done all the legal research necessary to prove that fraud and
harassment has occurred in a most outrageous fashion, including digging up
the relevant federal and virginia state codes. if we have any lawyers in the
group, i would appreciate the assistance of having you forward this same
letter to the creditor, once again, and ask them to cease and desist this
incredible ordeal i have been put through. i had already requested before,
with a notarized letter, that all further communications on this outrage be
directed by written mail, and they have gone back to their old tricks.
sprint is playing dumb by saying that they sold it to a collection agency
and therefore it is not their debt anymore. so now we have to go to the top
of this other agency and do what i would have done to sprint.
i would prefer to work with someone i already know... and there are other
options, but i figured i'd set it out there with you first. i don't want to
get all worked up over this. it is very, very clearly a negative greeting
and i am elevating it from out of the shadows so it can be exposed and
healed.
peace be with you -

i had a similar problem with a phone company pulling a large bill out of
thin air and sending me demand letters for it a bit back; unfortunately i
didn't have quite the same level of documentation to back me up that you do,
but because i knew their claim was baseless, i simply ignored them. they
haven't taken any further action against me, and since the bill dates from
1999, they're now no longer legally allowed to do so.
i'm not a lawyer, but given the amount of evidence you've got of the fraud,
i'd ring them up and tersely inform them that if they want to take you to
court over it, that that's fine...with the amount of evidence you've got,
the judge will laugh at them, and the only thing they'll really accomplish
is to make themselves look like fools. i would then say that after they'd
lost *that* case, i'd then launch one of my own...a civil suit for fraud and
legal harassment, and that i'd take steps to get media coverage for it as
well...which they would likely find extraordinarily bad for business. i'd
then finish that by saying that it would therefore overwhelmingly be in
their best interests to back off. do the same with the debt collectors, but
inform them that they also stand a chance of being sued as accomplices with
sprint in a conspiracy to defraud...if you present them with your evidence,
i'm suspecting they'd withdraw rather quickly.

david -
have you reported this to the ftc and fcc? there is a procedure for
complaints on both of their websites.
( i looked up the process on the
<https://rn.ftc.gov/dod/wsolcq$.startup?z_org_code=pu01> ftc one time,
got the complaint procedure down pat. subsequently, when i got into it
with a credit card company i started rattling off the steps that i would
be pursuing in my "filing" with the ftc. when the customer rep heard
this, she put me on hold, and a senior management type person got on the
line and we worked it out. funny thing was that he specifically asked me
"about that letter, we sure wish you'd reconsider sending it to the
ftc", so it definitely pushed a button)...
also your federal congressional rep (house or senate) might be able to
add some pressure, since all the comm. guys ultimately answer to the
feds. in the light of the wrongdoing with worldcom
<http://money.cnn.com/2005/03/15/news...bbers/?cnn=yes> and
global <http://www.pbs.org/now/politics/corpscandalupdates.html>
crossing et. al. that should be of interest.
you probably already thought of all of this, but i thought i'd put it
out there.
good luck david, let us know if we can help out with anything... oh
wait, you did ....
cheers!
chuck

maybe... but, if you own your home, check and that the phone company
did not place a lien on it making it impossible for you to sell or
refi without paying it off.
in my case an orthodontist had placed a lien on my house which i
discovered when i went to refinance in 1994! the amount was a mere
$35.00 yet i had to show proof of payment to the loan company before
my loan was granted.
take care,

hi david
interesting that you have this arise again in your life, just after i watch
an interesting story regarding one man's credit drama. a guy did not return
a library book, and got a letter from the library requesting its return.
then he got a letter for a bill of $30 from the library. then he heard
nothing. within the following year he wanted a loan (or a job...?) and was
rejected because he had a poor credit rating. in searching out why, he
discovered the unreturned book was the culprit, and that the credit rating
record would remain in force for 7 years! in approaching the library (the
news reporter) after the man felt this was an extreme punishment that did
not fit the crime, the library said, they could not afford to chase
outstanding bills, and felt it their right as the books in the library were
their business. the man in the news report then recommended to everyone not
to ignor those continued harassing calls and letters for outstanding debts,
as it does take alot of effort and wow 7 years to clear your credit rating!
dw: it is very, very clearly a negative greeting and i am elevating it from
out of the shadows so it can be exposed and healed.
in light of the above, this is a very wise decision, and i trust in
evaluating all information/evidence again, and recognizing the oneness of
all, you will be able to perhaps 'see the other side of the story' and
perhaps more importantly, they will 'see your side' and a harmonious
resolution ensue
i can see you are 'into a prosperous resolution for
all'. so many are simply doing the job they are 'told to do', for they too
need to earn an income to pay the bills and feed their famliy
in my
humble opinion for what it is worth, sprint in selling that debt to a
collection agency is also acccountable in light of the 'recognition of error
on their part' and their agreement/settlement with you on the other bill.
this made public, does not give such a provider the 'desired publicity' as a
trustworthy provider, and may provide further assistance to you
creating the desired outcome and allowing it to unfold, as it will
z
peace be with you -

RE: Is there a Lawyer in the House?
after reading your post (david) about all the trouble you been having
with sprint i decided to climb up top the road with my digital camera
and take a picture of the roof of my house.
i then proceeded to upload the following photograph
http://photos.groups.yahoo.com/group/asc2k/vwp?.dir=/&.dnm=steve+and+s
print+008.jpg&.src=gr&.view=t&.hires=t
i hope it's ok. i haven't the foggiest idea of how i'm going to tie
all this in to the law of one but after reading david's post and how
he got ripped off by sprint i felt compelled to post this. maybe i'm
going to have to go and dig up all my old phone bills but i had three
months where i was expected to pay in excess of 170 dollars in
charges when my regular bill for one phone line and one internet line
is usually around 45 dollars. all of these charges were for moving
one of my phone lines over to the house i work on and keeping an
internet line at the existing house and i was told there would only
be an installation charge... when i got the third bill i was so
enraged i grabbed a can of bright red marking paint and climbed up on
my roof and spray painted my message. the only reason i have never
made a big deal about it was because i spelled thieves wrong for if
you haven't clicked on the picture it says in two foot high spray
painted letters on my roof "sprint are thievs" i don't know why i am
such a bad speller. i remember my science teacher gave me an f on a
test one time because he had marked every miss spelled answer wrong
and i had gotten a perfect score. it's kind of ironic that right at
the miss spelling is the source of my roof leak which is right over
my bed... but getting back to my sprint story when i called to pay
the bill it was obvious that they base their billing on whatever they
could get away with. i told her how i had been put thru all the
series of recordings and how they were obviously there to intimidate
people into paying the bill as i did. i'm so disgusted i don't even
want to think about that part. i am absolutely convinced that our
entire communications system is controlled and monitored by thieves.
if i ever become wealthy i swear i am going to spend my entire
fortune on constructing some sort of free communications system that
rivals the internet and the telephone and will put them all out of
business. i'm rambling all over the place not even saying what i
intended to say. i know there is already some sort of way that all of
us communicate and that it is beyond words. i guess the problem is
any attempt at explaining it is also beyond words so we can either
all pretend it doesn't exist or realize it does and play with it to
develop it. anyway till that happens we are stuck with sprint and the
rest of them that are no better. i don't know anyone who hasn't been
overcharged on their phone bill no matter what the company... don't
even get me started on cellular. we don't need a lawyer david we need
a revolution!
